Terms of service

These terms are the agreement between you and Amortoae Petru PFA, which runs MotiveLeads, when you create an account or buy anything at getmotiveleads.com. In these terms, MotiveLeads and we mean Amortoae Petru PFA. Read them with the privacy policy, the refund policy and the cookie policy. If you do not accept them, do not use the service.

The service

MotiveLeads sells pre-audited business prospect data and generated outreach copy. A lead is a local business with checked contact details, a scored audit of its public website with screenshots where it has one, up to 3 local competitors where we find them, and an outreach sequence written for your pitch profile: 3 emails, a call script and a text message. Each lead also comes with a white-label PDF. MotiveLeads does not send email for you: you send from your own tools. Credits give access for 12 months from purchase.

Scores and findings describe what we measured on the public website when we checked it. They are an estimate of opportunity, not a promise of a reply, a meeting or a sale.

Your account

• MotiveLeads is for businesses and freelancers buying for their work. An account belongs to 1 person; there are no team accounts.
• Give accurate details, keep your password to yourself and tell us at once if you think someone else used your account.
• You are responsible for what happens in your account, including every lead bought and every email sent with its data.

How leads are sold

You buy a lead one of two ways, priced in credits by its best tier across the 6 services:

• Shared. A shared lead is sold to up to 3 buyers in total, whatever service each one sells.
• Exclusive. An exclusive lead is sold to 1 buyer only, for every service. It can be bought only while nobody holds a copy of it, and once you buy it, it leaves the marketplace.

The service you pick when you buy only chooses the audit view, the sequence and the PDF you get; it does not change the price or limit what you may offer the business. Availability can change until your checkout completes: if a lead sells out first, it is not charged. A lead stays on sale for 45 days after it is published.

The list prices today, per lead, by that best tier:

The price of each lead is 0.8 to 1.3 times its list price, by the size of its metro area. Prices by metro size gives the bands. The price shown in your cart when you check out is the price you pay. We may change prices for future purchases; a change never touches a lead you already bought.

Credits

• You buy credits in packs through Creem, our payment provider and merchant of record: 20 credits for $19, 55 credits for $49, 120 credits for $99, 325 credits for $249.
• Credits are valid for 12 months from the day you buy them. We spend your oldest credits first, and credits that reach the end of their validity expire and leave your balance. We email you before that happens.
• Credits are not money: they cannot be exchanged for cash, except as the refund policy allows, or moved to another account.
• Unspent credits can be refunded on request within 14 days of purchase. See the refund policy.
• Deleting your account forfeits any credits left on it.

Free leads

A new account can claim 3 free leads after confirming its email address and, where we ask for it, a mobile number. Free leads are shared, and the best tier of each is B or C. One set of free leads is available per person and per phone number; we may refuse or withdraw free leads claimed through duplicate accounts, temporary email addresses or other abuse.

The guarantee

If the email address of a lead you bought bounces, or its data is wrong, report it from the lead page within 7 days of purchase. The credits you paid for that lead return to your balance automatically, to the pack they were spent from, and expire with that pack. Refunds under the guarantee are credits, never cash. The guarantee returns what a lead cost, so it gives nothing back for a free lead, which costs no credits; we still recheck the address you reported.

Your duties when you send

You are the sender of every message you write with MotiveLeads data, and you are responsible for following the law that applies to it. Depending on where the business is and where you send from, that includes:

• CAN-SPAM (United States). Use accurate sender details and a subject line that does not mislead, make clear the message is an advertisement, include a valid postal address and a clear way to opt out, and honor an opt-out within 10 business days.
• CASL (Canada). Have consent: express consent, or implied consent where the business published the address conspicuously, did not say it does not want messages, and your message is relevant to its business. Identify yourself, include a working unsubscribe, and honor it within 10 business days.
• Spam Act 2003 (Australia). Have consent, which can be inferred from an address published conspicuously when your message is relevant to the role, identify yourself, include a working unsubscribe, and honor it within 5 working days.

Honor every opt-out a business sends you, and do not contact again a business that asked you to stop. Your suppression list in your account keeps those businesses out of your exports.

What you may not do

• Resell, share, publish or redistribute lead data, in whole or in part, or add it to a list or database that other people can use. You may use the data you buy to offer your own services to the business, and give the white-label PDF to that business.
• Scrape, crawl or copy the marketplace with automated tools, or collect data from it other than through the exports we provide.
• Use the data to send messages that are unlawful, deceptive or harassing, or for anything other than business outreach.
• Use the outreach copy generator against the rules in the next section.
• Get around limits, caps or security checks, or open accounts to claim free leads more than once.

Rules for the outreach copy generator

For each lead you buy, MotiveLeads writes an outreach sequence for your pitch profile: 3 emails, a call script and a text message. Software generates it from the audit findings of that lead and from the profile you give us, and it may use an AI language model to write the wording. It is a draft for you to review, not a finished message. You are the sender, and you are responsible for every message you send.

You may use the generator only to write business outreach to the business the lead describes, offering your own services. You may not use it, or what it produces, to:

• Make false or misleading claims about the website or results of the business, about your own work, experience, clients or prices, or about a relationship you do not have, for example by claiming to be its current provider or a partner of a platform or company.
• Pressure or frighten a business with threats, false urgency or invented consequences, such as saying it has been hacked, will be penalized or will lose customers when the audit does not show it.
• Impersonate a person, business or authority, or hide who is sending the message.
• Write messages that break the law that applies to them, including the laws listed under Your duties when you send, or that sell illegal goods or services, adult content, gambling, weapons, financial scams, malware or phishing.
• Contact people as consumers, or for any purpose other than business outreach.
• Put into your pitch profile instructions meant to make the generator write something other than outreach, or content that is hateful, harassing, sexual or that promotes violence or self-harm.
• Use the generated text or the lead data to train or fine-tune a language model, or to feed a service that resells or republishes it.

Read and edit each message before you send it. Generated text can contain mistakes, and a finding describes what an automated check measured on the day we scanned the site, so check that it is still true. Do not send a call script or a text message in a way the law does not allow, including the Telephone Consumer Protection Act in the United States.

We may disable the generator for an account, delete generated copy, and suspend or close an account that breaks these rules, and we tell you why. If you received a message from a MotiveLeads buyer that appears to break them, email info@getmotiveleads.com.

Payments, chargebacks and suspension

Payments are processed by Creem, which is the merchant of record: it charges you, issues the receipt and handles sales tax. Prices on this site are before sales tax and VAT; where they apply, Creem adds them at checkout. When you open a chargeback or payment dispute, we suspend purchases on your account; they resume when the dispute closes in our favor or we settle it with you. When a refund leaves your balance below zero, purchases are paused until it is settled. We may also suspend or close an account that breaks these terms, and we tell you why.

Accuracy and liability

Lead data comes from public sources and our own checks at a point in time. Businesses change, so we cannot promise that every detail is still current; the guarantee is the remedy for a bounce or wrong data. To the extent the law allows, our liability for a claim is limited to what you paid for the credits concerned, and we are not liable for lost profits or indirect loss. Nothing in these terms limits a liability the law does not allow us to limit.

Ending your account

You can delete your account at any time from your account settings. Deleting the account forfeits unused credits. After deletion we keep order records for accounting, as the privacy policy describes.

Governing law

These terms are governed by the law of Romania, and its courts hear any dispute. If you are a consumer in the European Union, you keep the protection of the consumer law of the country where you live, and you may bring a claim there.

Changes and contact

When these terms change, the date at the top changes with them, and we email account holders before a change that affects them applies. Questions about these terms go to info@getmotiveleads.com.
